Terms and Conditions of Use and Sale (T)

1. Website Overview

The website www.evidive.com (hereinafter referred to as “the Site”) is an online platform operated by LAM2 Sàrl, with its registered office at Rue Mauborget 8 – 1510 Moudon, registered with the commercial register under number CHE-364.203.926.

The Site allows users to book scuba diving activities offered by partner dive centers (hereinafter referred to as “Partners”).

2. Acceptance of the T

Use of the Site implies full and complete acceptance of these Terms and Conditions of Use and Sale. By booking an activity on EviDive, the user (hereinafter “the Client”) acknowledges having read, understood, and unreservedly accepted these T

3. Services Offered

EviDive connects clients with dive centers. The Site allows you to:

• Browse scuba diving activity offers.
• Book and pay for services offered by Partners.
• Review experiences after activities.

EviDive is not the provider of the activities offered, but an intermediary between the Client and the dive center.

4. User Account

Booking activities requires the creation of a personal account. Users agree to provide accurate, up-to-date, and complete information.

The user is solely responsible for the confidentiality of their login credentials.

5. Bookings

Bookings are made via the Site according to the terms indicated in each activity’s description sheet. Once the booking is confirmed, the Client receives an email confirmation.

Some centers may request additional confirmation (medical certificate, diving level, etc.).

6. Prices and Payments

Prices displayed on the Site are expressed in EUR and include applicable taxes.

Payment is made online via secure methods.

EviDive may collect a commission on each booking, without additional cost to the Client.

7. Cancellation and Refund Policy

Cancellation conditions are defined by each Partner and are listed on the activity’s description sheet. The Client undertakes to consult them before any booking.

In case of cancellation by the Partner (weather conditions, unavailability), the Client may choose:

• Rescheduling,
• A credit,
• A refund according to the Partner’s conditions.

EviDive will endeavor to facilitate mediation, but is not responsible for refunds decided by the Partners.

8. Liabilities

• EviDive acts as an intermediary and cannot be held responsible for the execution of services provided by the Partners.
• The Client is responsible for ensuring they are physically fit for diving.
• EviDive disclaims all liability in case of accident, damage, or non-compliance with safety instructions during activities.

9. Reviews and Comments

Clients can leave a review after an activity. Comments must be sincere, respectful, and based on a real experience.

EviDive reserves the right to moderate or delete any content deemed inappropriate.

10. Intellectual Property

All elements of the Site (logo, texts, photos, videos, code…) are protected by current intellectual property laws. Any reproduction without authorization is prohibited.

11. Personal Data

Personal data collected is processed in accordance with our Privacy Policy and current laws, including GDPR (for European users).

The Client can exercise their rights of access, rectification, and deletion by contacting: privacy@evidive.com

12. Applicable Law and Disputes

These T are governed by Swiss law.

In case of dispute, an amicable solution will be sought. Failing that, the competent courts will be those of LAM2 Sàrl’s registered office.
